Household workers are people who perform services in and around your home such as gardeners, housekeepers, cooks and nannies. Part-time gardeners, housecleaners and similar workers can be ICs if they are running their own businesses. However, it’s unlikely that a nanny or other in-home child care worker could qualify as an IC. The agreement on the CD-ROM is tailored to use with those household workers who qualify as ICs.
This agreement is as simple and short as possible. It contains a series of boxes for you to check off to indicate exactly what services the worker is required to perform. You can add to these short descriptions if you wish.
The agreement states that the worker will provide all equipment and materials, since this strongly supports IC status. However, if you will be providing any equipment—a lawn mower or vacuum cleaner, for example—delete that reference in the agreement.
Since the worker will be working in and around your home, you need to set up a work schedule. This agreement provides that you and the worker will set up a mutually agreeable schedule. You don’t need to set forth the schedule in the agreement. Instead, simply state where the work will be performed.
